The United Nations Support Mission in Libya (UNSMIL) is following with concern the escalating dispute over the constitutional judiciary. This dispute risks undermining the unity, independence, and integrity of the judiciary. The judiciary is a core pillar preserving the unity of the state of Libya and were the judiciary to become divided, it has far-reaching implications on all aspects of Libyan life. UNSMIL calls upon all parties to refrain from any actions that could lead to divisions within the judiciary, or any statements that could be perceived as provocative and that could lead to increased tensions. UNSMIL emphasizes the importance of such restraint in light of the existing political divisions within the country. UNSMIL affirms that a unified and independent judiciary is a cornerstone of the rule of law and democratic governance. The Mission urges all relevant Libyan judicial and political actors to engage in constructive dialogue to resolve this important issue in a manner that preserves judicial institutional unity and serves the higher national interest for all of Libya. Upon request, UNSMIL stands ready to support Libyan-led and owned, consensus-based efforts aimed at safeguarding a unified judiciary and the rule of law.
